Terms of Service

Please read these terms carefully before using Migo.

1. Acceptance of Terms

By accessing and using Migo ("the Platform"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform. These terms apply to all users, including customers, venue providers, and content creators.

We reserve the right to modify these terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified terms.

2. User Accounts

To use certain features of Migo, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate, current, and complete information
  • Notifying us immediately of any unauthorized access or security breach
  • Ensuring you are at least 18 years old or have parental consent

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

3. Bookings and Payments

Booking Policy:

  • All bookings are subject to availability and venue confirmation
  • Bookings can be made up to 30 days in advance (subject to venue policies)
  • A 5% platform fee is added to all bookings to support platform operations
  • Payment is processed securely through our payment partners
  • You will receive instant confirmation via email and in-app notification

Cancellation Policy:

  • Full refund if cancelled 24+ hours before your booking start time
  • No refund if cancelled within 24 hours of booking start time
  • Refunds are processed within 5-7 business days to your original payment method
  • Venue-specific cancellation policies may apply and will be clearly displayed
  • In case of venue cancellations, you will receive a full refund automatically

No-Shows:

Failure to show up for a confirmed booking without prior cancellation will result in forfeiture of your payment. Repeated no-shows may result in account suspension.

4. Provider Obligations

Venue providers and service providers on Migo must:

  • Provide accurate venue information, including photos, descriptions, and amenities
  • Honor all confirmed bookings made through the platform
  • Maintain their venue and equipment in good, safe condition
  • Comply with all applicable laws, regulations, and licensing requirements
  • Keep their calendar, pricing, and availability information up to date
  • Respond to booking requests and customer inquiries in a timely manner
  • Not engage in off-platform transactions to avoid platform fees
  • Report any issues or incidents immediately

Providers who consistently violate these obligations may be removed from the platform.

5. Prohibited Activities

You may not:

  • Use the platform for any illegal purposes or fraudulent activities
  • Post false, misleading, defamatory, or fraudulent information
  • Interfere with the platform's operation or security
  • Attempt to gain unauthorized access to any part of the platform
  • Harass, abuse, threaten, or harm other users or providers
  • Create multiple accounts to manipulate ratings or reviews
  • Scrape, copy, or extract data from the platform without permission
  • Use automated systems (bots) to interact with the platform
  • Circumvent any booking fees or payment processing
6. Intellectual Property

All content on Migo, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, software, and the compilation thereof, is the property of Migo or its licensors and is protected by Sri Lankan and international copyright and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from Migo without our express written permission.

By posting content on Migo (reviews, photos, itineraries), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content on our platform.

7. Limitation of Liability

Migo acts as a marketplace platform connecting users with venue providers. We do not own, operate, or control the venues listed on our platform. Therefore:

  • We are not liable for the quality, safety, or condition of venues or services
  • We are not responsible for injuries, losses, or damages that occur at venue locations
  • We do not guarantee the accuracy of information provided by venue providers
  • We are not liable for any disputes between users and venue providers
  • Our total liability is limited to the amount of platform fees paid for the relevant booking

Use of the platform is at your own risk. We recommend users verify venue details and read reviews before booking.

8. Dispute Resolution

In the event of a dispute between you and Migo or between you and a venue provider:

  • First, attempt to resolve the issue by contacting our customer support team
  • We will mediate disputes in good faith but cannot guarantee resolution
  • If mediation fails, disputes will be governed by the laws of Sri Lanka
  • Legal proceedings must be conducted in courts located in Colombo, Sri Lanka
9. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms of Service
  • Fraudulent or illegal activity
  • Abuse of the platform or other users
  • Repeated no-shows or cancellations

You may delete your account at any time through your account settings. Upon termination, you will lose access to all bookings, reviews, and saved information.
